Sen. Elissa Slotkin, D-Mich., is under investigation by federal prosecutors following her participation in a video urging military and intelligence personnel not to carry out illegal orders, her office confirmed Tuesday.
Slotkin told The New York Times she learned of the investigation from the office of U.S. Attorney Jeanine Pirro in the District of Columbia. Her office confirmed the remarks to NBC News but provided no additional details.
“Facts matter little, but the threat matters quite a bit,” Slotkin told the Times. “The threat of legal action; the threat to your family; the threat to your staff; the threat to you.”
Pirro’s office did not respond to a request for comment Tuesday night.
Slotkin, a former CIA officer who served in Iraq, is the second lawmaker to face scrutiny over the video, which was released in November.
Sen. Mark Kelly, D-Ariz., a retired Navy captain and former astronaut, filed a lawsuit Monday after Defense Secretary Pete Hegseth sought to censure and demote him. The Defense Department called his comments in the video “seditious statements.” Kelly called the action “unlawful and unconstitutional.”
Trump criticized the video participants in November, describing their actions as “seditious behavior.” He later clarified that while he considered them in “serious trouble,” he was not threatening them with death.
Other lawmakers who appeared in the video include Reps. Chris Deluzio and Chrissy Houlahan of Pennsylvania, Maggie Goodlander of New Hampshire, and Jason Crow of Colorado.
After Trump’s initial comments, Slotkin said she received threats and that U.S. Capitol Police placed her under 24-hour security.
NBC News also reported this week that Pirro launched a criminal investigation into Federal Reserve Chair Jerome Powell, a frequent target of Trump’s criticism. On Sunday, Powell said the Justice Department was considering charges related to his congressional testimony about renovations at the central bank.
